Terms and Conditions

These Terms and Conditions apply to and form an integral part of all quotations and offers made by Seller i.e. The Concrete SHOP , all acceptances, acknowledgements, and confirmations by Seller of any orders by Buyer, any agreements regarding the sale by Seller (“Agreements”) and purchase by Buyer of goods and services (“Products”), unless and to the extent Seller explicitly agrees otherwise.

Store Terms

You signify that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and have given us your agreement to enable any of your minor dependents to use this site, by agreeing to these Terms of Service.

You may not use our goods for any unlawful or unauthorised purpose, and you may not break any laws in your area by using the Service (including but not limited to copyright laws).

You must not send any worms, viruses, or any other disruptive programming.

Any breach or violation of the Terms will result in your Services being immediately terminated.

Conditions of use

By using our website and services, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to contact us for further clarification. The Concrete Shop only grants use and access of this website, its products, and its services to those who have accepted its terms.

Payment terms

We accept only advance payment for order value below 1 million Rupees. For order value above 1 million Rupee, The Concrete SHOP may grant various slabs of instalments of payment. In any case, once our account office receive full payment for entire order/shipment, our account office will trigger signal to warehouse to dispatch material/product to buyer/project.

The Concrete Shop reserves the right to require the Buyer to pay for Goods in advance if the Buyer fails to maintain credit account arrangements. Taxes and other charges, any tax, fee, or charge of any nature whatsoever imposed by any governmental authority, on or measured by the transaction between Seller and Buyer shall be paid by Buyer in addition to the prices quoted or invoiced.

Intellectual property

You agree that all materials, products, and services provided from The Concrete Shop are the property of The Concrete Shop, including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce our intellectual property in any way from a new trademark registration (“unless, The Concrete Shop has entered upon an agreement with you for the same”)

For issues regarding intellectual property claims, you should contact the company to come to an agreement.

User Accounts

As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content at our sole discretion.

Applicable Law

By entering into an agreement, you agree that the laws of the Ahmedabad Jurisdiction, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between The Concrete Shop and you.

Disputes

Any dispute related in any way to your using of service, using this website, to products you purchase, or the franchisee shall be arbitrated by Ahmedabad Jurisdiction only and you consent to exclusive jurisdiction and venue of such courts.

Indemnification

You agree to indemnify The Concrete Shop and its affiliates and hold The Concrete Shop harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on liability

The Concrete Shop is not liable for any damages that may occur to you because of your misuse of our product or services.

Seller reserves the right to unilaterally modify or amend any portion of these Terms and Conditions at any time without notice prior to seeking your ascent to these Terms and Conditions.

All sales are subject to and expressly conditioned upon the terms and conditions contained herein, and upon buyer’s assent thereto. No variation of these terms and conditions will be binding upon seller unless agreed to in writing and signed by an officer or other authorized representative of seller.

To the extent these Terms and Conditions are either included with or incorporated by reference into any purchase order or other document to which Buyer is a party, Buyer acknowledges that execution of such purchase order or other document provides conclusive evidence of notice and Buyer’s knowledge of these Terms and Conditions, as may be amended from time to time.

Liability on Orders and Delivery

Orders arising hereunder may be changed or amended only by written agreement signed by both Buyer and The Concrete Shop, setting forth the changes to be made and the effect, if any, of such changes on the price and time of delivery. Buyer may not cancel this order unless such cancellation is expressly agreed to in writing by The Concrete Shop Carriers are to be chosen by The Concrete shop, with normal carrier freight prepaid by The Concrete shop. If the The Concrete shop agrees to transfer the service of delivery of products to the buyer, then the carriers are to be chosen and the charges are to be paid by buyer and title and risk of loss or damage transfers to Buyer at that point.

The Concrete Shop maintains the right to choose the precise manner of shipment at its discretion. The Concrete Shop reserves the right to deliver in installments, with each payment being billed individually and paid for when due per invoice, regardless of subsequent deliveries. Buyer’s duties to accept remaining deliveries are not affected by any delay in delivery of any installment.

Delivery dates communicated or acknowledged by The Concrete Shop are approximate only, and The Concrete Shop shall not be liable for, nor shall The Concrete Shop be in breach of its obligations to Buyer, for any delivery made within a reasonable time before or after the communicated delivery date.

The Concrete Shop performance under any order accepted pursuant to these Terms and Conditions shall be excused in the event of fire, explosion, flood, severe weather, accident, strike, governmental act, embargo, shortage of raw materials or fuel, computer system failure, war or military action, riot, civil disturbance, or any other event beyond our control.

Accuracy of Billing and Account Information

Any order you place with us is subject to our discretion. We have the right to limit or cancel amounts ordered per person, per household, or per order at any time. Orders placed by or under the same customer account, the same payment card, and/or orders that utilise the same billing and/or delivery address may be subject to these restrictions. We may seek to tell you if we make a modification to or cancel an order by contacting the e-mail address and/or billing address/phone number supplied at the time the purchase was placed. We have the right to limit or reject orders that appear to be placed by dealers, resellers, or distributors in our sole discretion.

Cancellation

The Concrete Shop will notify Buyer the total charge for any cancellation, and in which the buyer agrees to pay such charges, where the cost had to be levied by Buyer in adherence to the buyer’s orders.
